Summary of Case: |
"Carol Jean Wilson was wrongly convicted on October 14, 2011 in Wayne County, Michigan of forging the account holders name on a check that was made payable to Wilson's company. Wilson was sentenced to probation on October 28, 2011. Her appellate lawyer conducted a post-conviction investigation that discovered the check was in fact signed by the alleged victim. Wilson filed a motion for a new trial based on her trial lawyer's ineffective assistance of counsel for failing to discover the new evidence prior to her trial. Wilson's trial judge denied the motion and she appealed. On June 4, 2013 the Michigan Court of Appeal reversed the lower court's ruling and granted Wilson a new trial based on her trial counsel's failure to thoroughly investigate the signature on the check constituted ineffective assistance of counsel. On September 30, 2013 the Michigan Supreme Court denied the prosecution's writ of certiorari. The Wayne County DA's Office filed a motion to dismiss the charges in the "best interest of justice" which was granted on December 5, 2013." |
