Winfrey was sentenced to seven years in prison. Winfrey appealed his guilty plea. The Missouri Supreme Court ruled on January 15, 2008 that state law requires proof that a person took money or something of value from, or while participating in, gambling. Since Eric Winfrey did not actually participate in a gambling game, his conduct didn't constitute a crime. His guilty pleas were withdrawn and his convictions were set aside."
