Summary of Case:	"Samantha Irene Wright was 19 when on November 5, 2007 she admitted to the mother of a boy she babysat in Rockaway Beach, Oregon that she spanked him three times. During her trial in 2009 the prosecution's medical expert testified the bruises were "superficial." Wright was convicted of first degree criminal mistreatment based on bruises on the boy's buttocks and leg. In May 2009 she was sentenced to three years probation. She appealed and on November 7, 2012 the Oregon Court of Appeals overturned her conviction on the basis first-degree criminal mistreatment requires the infliction of a "physical injury" as an essential element of the crime, and the boy's superficial bruises didn't meet that requirement. Since her conviction was oveturned on insufficient evidence her retrial is barred by double jeopardy."
