Judicially Exonerated Posthumously after Execution

Summary of Case:

"Wrongly convicted by a military court on August 28, 1961 of collaboration with North Korea, and sentenced to death. In February 1961 Jo Yong-su, 31, founded the Minjok Ilbo meaning People's Newspaper. His newspaper ran many stories exposing corruption in South Korea's government and the paper was editorially critical of government policies. Minjok IIbo became the top selling newspaper in South Korea. Yong-su was arrested on May 18, 1961, two days after General Park Chung-hee rose took over the South Korean government in a military coup. He was charged with collaboration based on accusations he set up the newspaper with North Korea's financial support and that he was a member of pro-North Korean underground organizations. Yong-su's conviction and sentence were upheld by an appeals court in October 1961, and he was 32 when executed on December 21, 1961. Jo Yong-jun, Yong-su's younger brother, filed a petition in 2007 to reconsider his brother's conviction. On January 16, 2008, Judge Kim Yong-seok of the Seoul Central District Court dramatically announced, "The defendant is innocent. There's no evidence that he participated in such pro-North Korean parties." With Yong-su's exoneration,his family members could file a suit for compensation from the South Korean. Jo Yong-jun is now 74 years old."
