"Idris Ibrahim Fahra, Andrew Kayachith, and Yassin Abdirahman Yusuf were codefendants wrongly convicted on May 3, 2012 of conspiracy to engage in sex trafficking of juveniles. After their convictions by a jury, but prior to their sentencing, the three filed motions for the judge to grant a post-verdict judgment of acquittal based on the prosecutions failure to introduce sufficient evidence to prove each of the elements of the single-conspiracy alleged in their indictment. The trial judge agreed, acquitting the three codefendants based on insufficient evidence of their guilt, and the government appealed. On March 3, 2016 the U.S. Sixth Circuit Court of Appeals affirmed the trial judge's ruling, stating: "Consequently, the variance between the charges in the indictment and the evidence produced at trial is reversible error and the acquittals are warranted."
